Delivery terms

1. Prices: The goods being sold will be sold at the list price in force at the time of delivery. This price list replaces and cancels the previous. 2. Discount: A discount may be applied to this list price it will be inclusive of the ordinary assistance fee. 3. Form of payment: Non-compliance with the established form of payment and agreed voids the right to receive other goods. All sales a credit, none excluded, are understood to be carried out with the particular agreement of reserves dominion until full extinction of the price and this also in the case that to cover this price, the buyer issues bills of exchange or that innovations have been granted on these. In case of failure payment on expiry of an installment that exceeds one eighth of the price established overall or in the event of non-payment of two installments, the contract shall be deemed terminated by law pursuant to the combined provisions by articles 1525 and 1456 of the civil code with right on the part of the seller - notwithstanding to the deposit referred to in the 1st paragraph of the art. 1526 of the civil code – to withhold the amount of accruals already received as compensation as well as to request compensation for i greater damage in relation to the wear and tear of the machinery in the period of use or mismanagement of the same and also the reimbursement of all expenses met for withdrawal, custody and eventual justice. 4. Delivery of goods: The delivery time indicated in working days, it must not be understood as mandatory and may be subject to variations for reasons that are not dependent on our will. 5. Return: For all products, return is carriage paid for full loads or in matching. For spare parts, the return is carriage forward. Materials travel at the risk and peril of the purchaser even in the event that the sale is carried out carriage free. For machines mod. PENTA and AMIS the return is always understood to be carriage forward. 6. Assembly: The assembly, unless otherwise agreed in writing, it is intended to be paid by the buyer. 7. Claims: Claims for incomplete or incorrect deliveries as well as for defects apparent must be communicated in writing within 8 days of receipt of the goods, meaning, after this term, the supplies have been accepted without reserves. Hidden defects must be communicated at the time of the survey ed in any case no later than 8 days it is up to the buyer to provide for those tests or inspections that make it possible to detect these defects. 8. Warranty covers the repair and/or replacement of those parts which are manufacturing defects. Complete replacement is excluded of the product. For all goods produced by Edil Lame Srl the guarantee is six (6) months from the date of shipment or delivery, against manufacturing defects or in the materials. Materials deemed defective must be returned at our factory, carriage paid, the return will take place in port assigned. In any case, they remain the exclusive responsibility of the buyer labor and travel expenses related to the repair or replacement possibly carried out at the buyer's premises. All requests must be reported using our form ELMD1901 ( downloadable from our website) together with a copy of the coupon guarantee ( page 19 of this booklet ) and the purchase invoice with reported badge number. It will be our Uff. Technician to give the approval for the repair. 9. WARRANTY CONDITIONS 1a. The guarantee is accepted only in case the certifcate results fully completed and presented together with the proving invoice the purchase and the guarantee coupon; also no alter-ation o cancellations must be made to the certificate itself. 2b. Edil Lame's obligations are limited to the repair or, at its discretion discretion, to the replacement of defective parts. 3c. The guarantee of this product will immediately expire if the same will be modified and adapted to different technical and safety regulations from those in force in the country for which the product was designed e built. No refund will therefore be provided for damages deriving from changes mentioned here. 4d. The guarantee of this product will immediately expire if the machine will not undergo scheduled ordered maintenance stability. 5e. This warranty does not cover: a) Periodic checks, maintenance, repairs or replacement of parts subject to wear such as crown, pinion, screw, belts, pulleys, oil seals, etc. b) Costs related to transport, movement or installation of this product. c) Improper use, errors of use or incorrect installation. d) Damages caused by fire, water, natural phenomena, war, public motions, incorrect power supply, insufficient ventilation or any other cause employee of Edil Lame srl. e) ENDOTHERMIC engine (Guaranteed directly by the manufacturer). 6. This guarantee is valid for each person who takes possession formally of the product during the warranty period. The validity of the aforementioned guarantee is obviously directly related the method of use of the machine according to the instructions for use e maintenance contained in this booklet. It is obvious that the guarantee itself will not be valid in case of tampering of the components that the EDIL LAME SRL technicians will be able to ascertain in case of arbitrary dismantling of the machine or parts of it. They are not substitutions are allowed unless previously authorized by the manufacturer. Edil Lame srl advises the user to supervise maintenance of the mechanical components of the concrete mixer in particular, however warns the buyer and the user that the electrical parts will be excluded from this guarantee, with the exception of those components which have obvious manufacturing defects. Suggestion We advise the kind customer to keep the use and maintenance booklet constantly available to the user of the machine, make a photocopy of the warranty coupon and keep it at the office and at home (together with the purchase invoice) until it is lost because, in in this case, Edil Lame srl will be free from any commitment assumed with the purchaser. 10. Warnings: The retailer undertakes to inform the final purchaser and user on the instructions for use of the product and the warnings relating to use, given in the user manual e maintenance to be delivered together with the product. EDIL LAME s.r.l. pursues product improvement policy; yes therefore reserves the right to provide details more up to date. The characteristics of the products are therefore not binding and may be subject to change. EDIL LAME s.r.l. reserves a 5% tolerance on the technical data of all cars. The colors of the machines are indicative. All the machines comply with the “CE” - CEE regulations; 2006/42/EEC; 2014/30/EEC; 2014/35/EU; 200/14/EC; and are supplied complete with instruction manual, declaration of conformity, “CE” plate and safety signs.
